This Privacy Policy explains how DAELA (“DAELA”, “we”, “us”) collects, uses, shares and protects your personal information when you visit bydaela.com, join our waitlist, apply to one of our events, contact us or interact with us on social media, and, as DAELA grows, when you shop with us, sign up for text messages, enter a giveaway or join our creator program. DAELA is an activewear brand based in Miami, Florida.

Information we collect

Information you give us. When you fill out a form, place an order or take part in one of our programs, we collect the information you provide:

Waitlist: your email address and, if you choose to share it, your name and size.
Event applications: the event you are applying for, your name, email address and Instagram handle.
Contact form: your name, email address, the topic and your message.
Orders: when our online store opens, your name, email address, phone number, billing and shipping addresses and what you buy. Payments are handled by our payment processors; we do not store your full card number.
Text messages: if you sign up for texts, your mobile number and your messaging preferences.
Creators and partners: if you join our gifting, PR or affiliate program, your name, contact details, social media handles, shipping address, size and the details we need to pay any commissions.
Giveaways: the information the entry asks for, such as your social media handle, and for winners, the details we need to deliver the prize.
Photos, videos and reviews: content you send us, tag us in (@bydaela) or post as a review. We ask for your permission before we repost your photos or videos.

Information collected automatically. When you visit our website, we use Metricool, a web analytics service, to understand how visitors use the site. It collects information such as the pages you visit, the date and time of your visit, the website or app that referred you (for example, Instagram), your browser and device type, and your approximate location based on your IP address. This may involve cookies or similar technologies. We may also use advertising tools that collect similar information, as explained under Advertising below.

Information from other sources. We receive information from the social media platforms where you interact with us, such as your public profile, handle, comments and messages on Instagram, TikTok or Facebook, and summary reports about who sees our posts and ads. When our store opens, we will also receive information from payment processors and shipping carriers, such as payment confirmation and delivery status.

How we use your information

To manage our waitlist and send you launch updates and early access information.
To plan our production, for example how many pieces to make in each size.
To process and deliver your orders, handle returns and exchanges, and provide customer service.
To review event applications and send you event details.
To run our creator program and giveaways, including tracking discount codes and affiliate links so we can credit and pay creators.
To answer your messages.
To send you marketing emails and, if you opted in, text messages.
To show DAELA ads on social media to people who may be interested, and to measure how our ads perform.
To understand how visitors find and use our website and improve it.
To prevent fraud, keep our website secure and comply with the law.

Emails and text messages

Emails. If you join our waitlist, we will email you about DAELA, our launch and early access. You can unsubscribe at any time using the link in our emails or by writing to hello@bydaela.com.

Text messages. If you opt in to texts from DAELA, we will send you recurring automated marketing messages, such as launch news and offers, at the number you provided. Consent is not a condition of purchase. Message frequency varies. Message and data rates may apply. Reply STOP to unsubscribe or HELP for help.

We do not share your mobile number or your text message consent with third parties or affiliates for their own marketing. We share it only with the service providers that send our messages for us.

How we share your information

We do not sell your personal information for money. We share it only as described below:

Service providers that help us run DAELA, such as website hosting, our form tool (form entries are stored on our own website), web analytics (Metricool), email and text message delivery and, when our store opens, our ecommerce platform, payment processors, shipping carriers and customer service tools. They may use your information only to provide their services to us.
Advertising and social media platforms, such as Meta (Facebook and Instagram) and TikTok, as explained under Advertising below.
Creator and affiliate tools that track discount codes and referral links so we can pay commissions.
Professional advisers, such as lawyers and accountants, when needed.
Business transfers: if DAELA is involved in a merger, acquisition or sale of assets, your information may be transferred as part of that transaction.
Legal reasons: if required by law, or to protect the rights, property or safety of DAELA, our customers or others.

Advertising

We use, or may use, advertising tools from social media platforms, such as the Meta Pixel (Facebook and Instagram) and the TikTok Pixel. When you visit our website, these tools can collect information such as the pages you view, actions you take (for example, joining the waitlist or making a purchase), your IP address and your browser and device details. The platforms may connect this information to your account with them. This helps us show DAELA ads to people who may be interested and measure how our ads perform. The platforms use this information under their own privacy policies.

Under some US state laws, using these tools may be considered “selling” or “sharing” personal information for targeted advertising. You can opt out at any time:

Change your ad settings on Facebook and Instagram (Accounts Center > Ad preferences) and on TikTok (Settings and privacy > Ads).
Use the opt-out tools of the Digital Advertising Alliance and the Network Advertising Initiative.
Turn on Global Privacy Control in your browser (see below), or block cookies in your browser settings.
Email us at hello@bydaela.com and we will opt you out of any sharing we control.

Cookies

Our website uses cookies and similar technologies that are necessary for it to work, analytics cookies from Metricool to measure visits and, when we use them, advertising cookies and pixels, as explained under Advertising above. You can block or delete cookies in your browser settings; the website will still work.

Do Not Track and Global Privacy Control

Some browsers send a “Do Not Track” signal. Because there is no common standard for responding to these signals, our website does not currently respond to them. Global Privacy Control (GPC) is different: if your browser sends a GPC signal, we treat it as a request to opt out of targeted advertising, and our website does not load advertising pixels in that browser.

How long we keep your information

We keep your information only as long as we need it for the purposes described in this policy:

Waitlist: until our launch and for a reasonable period afterwards, or until you unsubscribe or ask us to delete it.
Orders: as long as we need it to provide customer service and to meet tax, accounting and legal requirements.
Events, creator program and giveaways: while the event, program or giveaway runs, and for a reasonable period afterwards.
Messages you send us: as long as we need to respond and follow up.

After that, we delete your information or make it anonymous.

Your choices and rights

You can ask us at any time to:

Access the personal information we hold about you and get a copy of it.
Correct information that is inaccurate.
Delete your information.
Stop sending you marketing emails or text messages.
Opt out of targeted advertising (see Advertising above).

To make a request, email hello@bydaela.com. We may need to confirm your identity before we act on it, and we aim to respond within 30 days. You can also authorize someone to make a request for you. If we cannot fulfill a request, we will explain why, and you can ask us to reconsider. We will never treat you differently for exercising your privacy rights. Depending on where you live, you may have additional rights under local law, and we will honor them as required.

Children

Our website is not directed to children under 13, and we do not knowingly collect personal information from them. If you believe a child has given us personal information, contact us and we will delete it.

Security

We use reasonable measures to protect your information. No method of transmission or storage over the internet is completely secure, but we work to keep your information safe. If a data breach affects your personal information, we will notify you as required by law.

Visitors outside the United States

DAELA is based in the United States. Your information may be processed in the United States and in other countries where our service providers operate, which may have different data protection laws from where you live.

If you are in the European Union, the United Kingdom or another region with similar laws, we process your information on these legal bases: your consent (for example, marketing emails and texts), to perform a contract with you (for example, delivering an order), our legitimate interests (for example, understanding how our website is used and keeping it secure) and to comply with legal obligations. You can withdraw your consent at any time, object to or ask us to restrict our processing, and complain to your local data protection authority.

Links to other websites

Our website links to other websites and apps, such as Instagram and TikTok. We are not responsible for their privacy practices, so please read their privacy policies.

Changes to this policy

We may update this policy as DAELA grows, for example when we open our online store. We will post the updated version on this page with a new effective date and, if the changes are significant, we will let you know by email or with a notice on our website.
